Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and WayWeGo ("we," "us," or "our") governing your access to and use of the WayWeGo mobile application and associated website (collectively, the "Service").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use WayWeGo. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration and Security

2.1 Account Creation

To use WayWeGo, you must create an account using a valid email address, or by signing in through Google or Apple authentication. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@waywego.app if you become aware of any unauthorized access to or use of your account.

2.3 Username Policy

Your username must be between 3 and 20 characters and may contain only letters, numbers, periods, and underscores. We reserve the right to reclaim or reassign usernames that violate our policies, are inactive for extended periods, or may cause confusion.

2.4 One Account Per Person

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, bans, or for any deceptive purpose is prohibited and may result in permanent termination of all associated accounts.

3. Description of the Service

WayWeGo is a social travel platform that provides the following features:

  • Social Discovery: Connect with other travelers, follow users, view travel posts with community ratings, and engage through comments and likes.
  • Messaging: Communicate with other users through friend chats, group chats, country-specific chats, activity chats, ride chats, and tour chats.
  • Activities: Create and join travel activities with other users, including specifying locations, dates, and participant limits.
  • Ridesharing: Offer or request rides with other travelers, including route, timing, and cost-sharing details.
  • Local Tips: Discover and contribute local tips and hidden gems with photos, descriptions, and reviews.
  • Tour Discovery: Browse, view, and book tours and experiences through our third-party tour partner, Viator.
  • AI Travel Planner: Generate personalized travel itineraries powered by artificial intelligence.
  • Travel History: Track and visualize your travel history on a personal map.

4. User Conduct and Community Guidelines

WayWeGo is built on trust, respect, and the shared love of travel. By using the Service, you agree to the following:

4.1 Prohibited Conduct

You agree not to:

  • Harass, threaten, intimidate, bully, stalk, or otherwise harm any other user.
  • Post content that is hateful, discriminatory, sexually explicit, violent, or otherwise offensive.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Post false, misleading, or deceptive information, including fraudulent travel tips, fake reviews, or inaccurate activity or ride details.
  • Use the Service to solicit money, promote commercial services, or send spam or unsolicited advertising.
  • Collect, harvest, or store personal information about other users without their explicit consent.
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems and infrastructure.
  • Use automated bots, scrapers, or other automated means to access or interact with the Service.
  • Circumvent, disable, or otherwise interfere with any security, rate-limiting, or access-control features of the Service.
  • Use the Service for any illegal purpose or in violation of any applicable local, national, or international law.

4.2 Content Standards

All content you share, including posts, tips, comments, messages, and media, must comply with these Terms and applicable law. Content should be relevant to travel, respectful of others, and accurate to the best of your knowledge.

4.3 Reporting and Moderation

We maintain a moderation system to enforce community guidelines. You may report any user or content that violates these Terms through the in-app reporting feature. We reserve the right to review, remove, or restrict any content or account at our sole discretion, with or without notice.

4.4 Consequences of Violation

Violations of these guidelines may result in content removal, account warnings, temporary suspension, or permanent termination of your account, depending on the severity and frequency of the violation.

5. User-Generated Content

5.1 Your Content

You retain ownership of the content you create and share on WayWeGo ("User Content"), including posts, photos, videos, tips, comments, and reviews. By submitting User Content to the Service, you grant WayWeGo a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and modify your User Content solely for the purpose of operating and improving the Service.

5.2 Content Responsibility

You are solely responsible for the User Content you share. You represent and warrant that you own or have the necessary rights to share your User Content and that it does not infringe on the intellectual property, privacy, or other rights of any third party.

5.3 Content Removal

You may delete your own content through the app at any time. We reserve the right to remove any User Content that violates these Terms or that we deem harmful to the community, without prior notice.

6. Ridesharing

WayWeGo provides a platform for travelers to coordinate shared rides. It is important to understand the following:

  • Peer-to-Peer Coordination: WayWeGo facilitates connections between travelers who wish to share rides. We are not a transportation provider, ride-hailing service, or taxi company.
  • No Guarantee: We do not guarantee the availability, safety, quality, or legality of any ride offered or accepted through the Service.
  • User Responsibility: Both ride offerers and participants are solely responsible for verifying the identity and suitability of the other party, agreeing on terms (including cost-sharing), and complying with all applicable transportation laws and regulations in the relevant jurisdiction.
  • Assumption of Risk: You acknowledge and accept that participation in ridesharing involves inherent risks, and you assume full responsibility for your decision to offer or accept a ride.

7. Activities and Meetups

WayWeGo enables users to create and join travel activities and meetups. By participating:

  • You acknowledge that WayWeGo is a platform facilitating connections and does not organize, supervise, or control any activities or meetups.
  • You are solely responsible for assessing the suitability and safety of any activity before joining.
  • Activity creators are responsible for providing accurate information about the activity, including location, time, and any relevant risks or requirements.
  • WayWeGo bears no liability for any harm, injury, loss, or damage arising from participation in any activity or meetup organized through the Service.

8. Third-Party Services and Tours

8.1 Tour Bookings

WayWeGo displays tours and experiences provided by third-party partners, including Viator. When you book a tour, you enter into a separate agreement directly with the tour provider. WayWeGo is not a party to that transaction and is not responsible for the quality, safety, or delivery of any third-party tour or experience.

8.2 External Links

The Service may contain links to third-party websites or services that are not owned or controlled by WayWeGo. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You access third-party services at your own risk.

8.3 AI-Generated Content

The AI travel planner generates itinerary suggestions based on your preferences. AI-generated content is provided for informational and inspirational purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated suggestions. You should independently verify all travel information, including opening hours, pricing, availability, and safety conditions, before making travel decisions.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, features, code, graphics, logos, trademarks, and all associated intellectual property, is owned by WayWeGo and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the software.

9.2 Feedback

If you provide us with suggestions, ideas, or feedback regarding the Service, you grant us the right to use and incorporate such feedback without restriction or compensation to you.

10. Account Suspension and Termination

10.1 By You

You may deactivate or delete your account at any time through the app's account settings. Account deletion is permanent and will result in the removal of your profile, personal data, and associated content in accordance with our Privacy Policy.

10.2 By Us

We reserve the right to suspend, deactivate, or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent or illegal activity, or behavior that is harmful to other users or the integrity of the Service.

10.3 Effect of Termination

Upon termination, your right to access and use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to Sections 5 (User-Generated Content), 11 (Disclaimers), 12 (Limitation of Liability), and 13 (Indemnification).

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, WayWeGo disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not endorse, guarantee, or assume responsibility for any content posted by users or any product or service advertised or offered by a third party through the Service.

WayWeGo is a platform that connects travelers. We do not verify the identity, background, or intentions of our users. You are solely responsible for your interactions with other users and should exercise caution and good judgment when meeting, communicating with, or traveling with other users.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAYWEGO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any user or third party on the Service.
  • Any interactions between users, whether online or offline, including participation in rideshares, activities, meetups, or tours.
  • Unauthorized access, use, or alteration of your data or content.
  • Any AI-generated content or recommendations provided through the Service.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of fifty euros (EUR 50) or the amount you have paid to WayWeGo, if any, in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless WayWeGo, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another person or entity; or (e) your participation in any rideshare, activity, meetup, or other interaction facilitated through the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to the competent courts of the Netherlands.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 30 days' notice through the app or by other appropriate means before the revised Terms take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WayWeGo regarding the Service and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
